Please feel free to release information that is transpiring in our community.

With the statements being made and presented to the public on behalf of the officials, some further FACTS should be made relevant to this matter.

Mark Bendell has been completely forthright in his statements to our Assemblyman, yet some major newspapers have not released the total picture.

With the issue in the community getting greater in Failed Safety to everyone in this District, it seems to me that proper and immediate news releases be met. This problem bears the respect and should be a priority to the people we serve.

I am not going to single out the faults here, merely get this the further movement to a corrective solution. Again, and I can not emphasize this enough, it is a County Issue, Town Issue and certaintly a Local Issue.

Thank You, for presenting the public with previous information, I/we need to continue a trek to make this failure of the Safety of the residents, non residents and our officials in the emergency services protected PROPERLY .

If anyone missed Mr. Bendells previous article of Assy. Millers- merely let me know and I will provide them.

Letters From Residents DCC/ Miller

Subject: Your endorsement of DCC to be it’s own lead agency.

Dear Assemblyman Miller,

I just wanted to let you know that your deeds do not go unnoticed.

In the past I would be one of the first to thank you for your support of our dilemma in Fairview.

Now I want to be one of the first to tell you that your latest non-support of Fairview in supporting DCC being their own lead agency for their residence halls project has left me speechless, saddened, dismayed and frustrated with your actions.

Your most recent action in supporting DCC to be its own lead agency is just another feather in the cap of those who seek to dissolve the Fairview Fire District. The same holds true for the Fairview Fire District Board of Fire Commissioners, if they should accept any agreement with DCC for remuneration to mitigate the negative impact the Residence Halls will have on the life safety of Fairview Firefighters and the residents they are sworn to protect. Unless, of course, such remuneration is equal to and not less than, what DCC would pay if they were a taxpaying entity which would be a far cry from the meagher $75,000 they originally offered and is now null and void.

While Dr. Conklin trashes support of the college from the community, his faculty and staff, you are right there to back him up. This is truly an outrage.

It’s time to put public life safety, the community and taxpaying constitutents FIRST above political interests. If you have any intention of saving any face at all in the community you were elected to serve, your strong support for this Assembly Bill and bringing whatever weight you may hold to strongly encourage its passage in both houses in Albany with all haste would be most pertinent.

Who will save us Assemblyman Miller while we constantly watch our homes decreasing in value, our taxes rising, our limited incomes taxed further to death by Governor Patterson with Albany’s latest round of new taxes (including but not limited to the MTA Tax) and our professional firefighters stretched beyond the limit. Will they be able to serve us when we need them or will they be too busy servicing those who receive free rides at our expense with their ever expanding tax-free campuses.

Some letters from the Residents. It seems when Fire gets HOT enough for the Political Politicians, actions arise. We’ll see, but this Legislator isn’t waiting for them. I only have another 25 years left, this must get DONE now !!!

My name is James R. Doxsey.

I am the Dutchess County Legislator representing Dist. 1 in the T/Poughkeepsie.

I am writing to express my great concerns in reference to the potential subject housing project and the Dutchess Community College’s subject petition.

Due to the rapid expansions of my District from the tax – free Not for Profit Organizations, the demands for services required currently are endangering our residents, commercial property owners, our fireman and our police.  Not to mention the 5500 local College residents in my District in dorms from another college.

With the Dutchess Community College potentially wanting to produce dormitories, the college currently has in fall of 2008 a total amount of 8,000 students, with an added 880 students recently, and a spring est. of 7,000 students with an increase of 11%. This totals to approx. 7,700 students along with the 8,000 from the other college.

The negative impact on our district is already over-bearing on the Fire District. The Fire protection is currently in-adequate to sustain safety for all area residents and such, and has been for many, many years now.

We can not provide additional protection to ANY type of construction currently, or in the future. The inability to do so puts lives in a constant danger.

The Fairview Fire District currently pays the Highest Fire Taxes in New York State; taxpayers can not afford ANY increases in the taxes.

We have Two Hospitals, Schools, Churches and dozens upon dozens of non – taxed property already. To a tune of 47% Tax Exempt.

With approximately 16% Emergency call for Fire and EMS, all going to the colleges alone. We have over 900 calls out of 1814 calls per year going to the NFP’s. This is creating the inevitable and unthinkable, yet a reality.

The Town of Poughkeepsie put in place a moratorium in 2008, to potentially stop the Dormitory being built on Dutchess Community Property, given to them by a 13/12 vote in Legislation.  As you can see the split vote passed, much to my dismay.

I had Both Towns of Hyde Park and Town of Poughkeepsie full support, my particular district has both towns in it. Multiple Fire, Police and EMS support, residents, business owners and alike turned out in protesting the College ( Dutchess ) from moving forward.

The District needs to address the cumulative impacts by the local Town Planning Board to resolve any more expansion of the District to the NFP’s. Until that happens, and I firmly believe it is not going to happen in the near future, we are threatening the lives every moment of every day of Everyone.

I respectfully request you to DENY the Dutchess Community Colleges request to become Lead Agency, and place the Lead Agency in either the Town of Poughkeepsie Planning Boards hands or the Local Fairview Fire Commissioners.

The risk of injury or worse is again inevitable, let the Town/Towns decide whose best interests are and should be the Lead Agency.

I close with respect to you and your fellow members to look out for the Safety and Wellbeing of my residents, fireman, students and all other people who are involved. Safety must be the main concern.

2004 Letter to Steinhaus

RE: Resolution No. 204273

Dear County Executive Steinhaus:

We are writing to request your approval of Resolution No. 204273 which urges the passage of New York State Legislation that would authorize fire commissioners to establish user fees upon tax exempt property for fire-fighting and rescue services.  As you know, the Dutchess County Legislature voted unanimously to endorse this resolution on October 13, 2004.

The Fairview Fire District has reached a critical point where the safety of the community and emergency responders is being compromised.  Fairview is currently operating with insufficient manpower to safely and effectively handle the demand of incidents and other services that are expected. A significant amount of the time Fairview is operating at incidents on tax-exempt properties with already limited minimal manpower and leaving the taxpayers, who pay a very high price for the expected immediate service, unprotected.  The taxpayers cannot afford to hire the additional staffing that is currently needed and what will be needed for guaranteed future growth within the district, especially that of tax-exempt properties.

In the effort to resolve this issue, New York State Assembly Bill A3019 was drafted with the assistance of Assemblyman Joel Miller and Senator Stephen Saland.  This bill would authorize a board of fire commissioners to establish user fees upon tax exempt property for fire-fighting and rescue services.  The criteria for imposing these fees would include that the fire district was comprised of over 50% tax exempt properties.

We are, and have been, at a point where the life safety of those we serve and protect and the lives of our own emergency responders are being jeopardized due to a lack of funding to provide adequate manpower.

It is not our desire to enter into the realm of taxing exempt institutions.  However, when it is these institutions that demand the most, use the services the most, and require an higher level of protection than most of those who actually pay for the service, then why shouldn’t they be required to contribute to the cost associated with it.  Quite frankly, if they do not start contributing to these ever increasing expenses, then the fire district may be left with the frightening possibility of closing it’s doors due to lack of funding and the liability associated with operating below every industry standard.

Fairview looks to you and the Dutchess County Legislature to assist in any way possible for the passage of this New York State Bill, to ensure that emergency services can afford to remain safe and efficient in operation.
